BUNIN is provided and operated from Spain by Konstantin Bunin (N.I.E. Y2703732G), calle Felipe Menéndez, 11, 3A, 33206, Gijón, Asturias, Spain — contact: support@thebunin.app.

1. Acceptance and eligibility

By using BUNIN, the user agrees to these terms and to the Privacy Policy.

You must be at least 18 years old to use BUNIN. The service is intended solely for adults and is not offered to children or minors. By using BUNIN, you confirm that you are 18 or older and have the legal capacity to enter into these terms. If you are under 18, do not use the service. Where you use BUNIN in relation to another person's health data, you confirm that you have the lawful authority to do so.

2. Service description

BUNIN is a personal health record platform for collecting, normalizing, encrypting, storing, and exporting user-controlled medical data. It may also support wallet-based consent and optional marketplace workflows.

BUNIN is designed as a local-first application: your health data is stored and processed only on your own device, under your control. Konstantin Bunin is responsible for providing the software and operating it securely; he does not control, store, or have server-side access to your health data. You remain in control of, and responsible for, your own health data.

BUNIN is not a medical device, not a diagnostic tool, and not a substitute for professional medical advice, diagnosis, or treatment. Using BUNIN does not create a doctor–patient relationship.

Any AI-generated commentary, summary, anomaly flag, or informational suggestion is non-diagnostic supportive context only and may be incomplete or incorrect. Always seek the advice of a qualified healthcare professional with any question about a medical condition, test result, or treatment, and never disregard or delay seeking professional medical advice because of something you read in BUNIN. This is especially important for serious, chronic, or life-threatening conditions, including oncological (cancer) diagnoses and treatment decisions.

In a medical emergency, call your local emergency number or seek immediate in-person care — do not rely on BUNIN.

Sharing of records or monetization of datasets requires a specific consent action. Consent is scoped to the request metadata presented at the time of signing. Where health data (a special category of personal data under Article 9 GDPR) is involved, this consent action also serves as your explicit consent for that specific processing, and you may withdraw it at any time as described in the Privacy Policy.

The service is provided on a best-effort basis during the MVP phase. Features, limits, and supported devices may change.

We may suspend or modify access for security, compliance, or operational reasons.

For material changes to these terms, we provide reasonable advance notice (normally at least 15 days) by in-app notice, website notice, or both, unless an immediate change is required for security, fraud-prevention, or legal compliance. Continued use after the effective date of an updated version constitutes acceptance to the extent permitted by mandatory law.

8. Disclaimers and limitation of liability

The service is provided on an "as is" and "as available" basis during the MVP phase, without warranties of any kind except those that cannot be excluded under applicable law.

To the maximum extent permitted by applicable law, Konstantin Bunin is not liable for any decision made by users, clinicians, or third parties based on medical records, exports, normalized values, or AI-generated commentary, nor for indirect, incidental, or consequential loss.

Nothing in these terms excludes or limits any liability that cannot be excluded or limited under applicable law. In particular, we do not exclude or limit liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, for gross negligence or wilful misconduct, or for any statutory rights (including mandatory consumer-protection and product-liability rights) that cannot lawfully be waived.

Because BUNIN is a local-first tool that does not store your health data on our servers, you are responsible for maintaining your own backups (for example, using the app's export/backup feature). To the maximum extent permitted by law, we are not liable for loss of locally stored data resulting from device loss, failure, or deletion.

For consumers in the EU/EEA, nothing in these terms limits mandatory remedies for non-conformity of digital content or digital services, or any other mandatory rights that cannot be waived under applicable consumer law.

9. License and intellectual property

Subject to these terms, BUNIN grants you a limited, non-exclusive, non-transferable, revocable license to use the app for its intended purpose.

Except where mandatory law permits otherwise, you may not copy, distribute, publicly display, reverse engineer, or create derivative works from the app or its content beyond what is necessary for lawful use.

All trademarks, branding, software, and documentation rights remain with their respective owners.

10. Force majeure

Neither party is liable for delays or failures caused by events beyond reasonable control (including major network outages, infrastructure failures, natural disasters, armed conflict, and lawful governmental orders), provided that the affected party acts with reasonable diligence to mitigate impact and resume performance.

11. Governing law and jurisdiction

BUNIN is operated from Spain by Konstantin Bunin (see the provider details above). These terms are governed by Spanish law and, where applicable, European Union law, including the GDPR. Nothing in these terms limits any mandatory consumer-protection rights you have under the law of your country of residence within the EU/EEA. If you are a consumer, you may bring proceedings in the courts of your own country of residence within the EU/EEA, or in the courts of Spain.

12. Support and disputes

Support, incident reporting, and rollback handling follow the support workflow. EU/EEA users may also lodge a data-protection complaint with their national supervisory authority — in Spain, the Agencia Española de Protección de Datos (AEPD) — as described in the Privacy Policy.
